The purpose of this paper is to assess the emergence of the pirate movements in the European Union. Our goal is to sketch the steps towards a research agenda for this grassroots political movement which gained momentum since 2009. To attain our goal we showed the re-signification of the concept of piracy in the debate around intellectual property and its institutional settlement. Afterwards we analysed the big political themes of several European Pirate Parties and their struggle to follow the preferences (...) of the median voter. We concluded with a set of hypotheses of which the most important is that the pirates will inscribe neither to the left nor to the right part of the political spectrum. (shrink)

Many of the problems we face can usefully be modeled as prisoners’ dilemmas. All the standard game-theoretic solutions to prisoners’ dilemmas lead, in the real world, to assurance games. But too often some aspects of our social interaction are as much obscured by, as illuminated by, game theory. Removing some of the epistemic constraints often accepted by game theorists will enable us to distinguish between productive and destructive prisoners’ dilemmas. This Article draws attention to a conceptual point that has been overlooked in recent discussions about the theoretical foundations of contract law. I argue that, rather than enforcing the obligations of promises, contract law concerns complaints against promissory wrongs. This conceptual distinction is easy to miss. If one assumes that complaints arise whenever an obligation has been violated, then the distinction does not seem meaningful. I show, however, that an obligation can be breached without giving rise to a valid complaint. (...) This Article illustrates the importance of this conceptual distinction by focusing first on the doctrine of substantive unconscionability. I claim that the doctrine can be best explained by the way in which a party who engages in exploitative behavior may lose her moral standing to complain. It is because such a party has lost her moral standing to complain that the law, through unconscionability doctrine, bars her from bringing a legal complaint. This explanation avoids the oft-issued charge of paternalism and it also offers benefits over an alternative state-oriented account developed recently by Seana Shiffrin. Using the conceptual distinction behind this account of unconscionability, this Article further argues that recent theoretical debates about the relationship between contract law and morality have been largely misconceived. Those debates have focused on whether contract law and morality impose parallel obligations. Once one appreciates the difference between imposing obligations and recognizing complaints, the comparison looks quite different. Contract law recognizes valid complaints against broken promises, much as morality recognizes moral complaints. (shrink)

This Article describes a jurisprudential puzzle—what I call the puzzle of the beneficiary’s bargain—and contends that adequately resolving this puzzle will require significant revisions to basic premises of contract law. The puzzle arises when one party enters into two contracts requiring the same performance, and the promisee of the second contract is the third-party beneficiary of the first. For example, a taxi driver contracts with a woman to transport her parents from the airport next week, and then the driver separately (...) enters a contract with the parents to transport them when the time comes. Is the second contract valid and enforceable, or does it fail for lack of consideration? This specific question—on which courts have split—implicates several important contract law doctrines. Moreover, it highlights a deep tension in our modern understanding of contractual obligation. This Article argues that adequately resolving the puzzle necessitates a general reconsideration of the relationship between rights and liability in contract law. Surprisingly, the best solution requires abandoning the foundational understanding that contract liability arises out of breach of a promisee’s right to performance. The puzzle thus offers a lens through which to examine—and even revise—the central concepts of modern contract law. (shrink)

Accountability for corporate social responsibility (CSR) and its societal challenges is undetermined, and it is unclear whether business or society should carry these responsibilities. Despite severe criticism from some, many organizations continue to invest in and promote CSR. The purpose of this multiple-case study was to increase the understanding of the phenomenon from the perspective of a purposeful sample of participants who contribute to CSR execution and who were representatives of the 10 organizations identified as active promoters. The participant corporations (...) (case studies), in Europe and North America, were mainly in the telecommunications industry. Study data came from 11 face-to-face, semistructured interviews with chief executive officers (CEOs) and other CSR key participants, a review of corporate archival records, and a review of other sources regarding the effective implementation of CSR in these organizations. The conceptual framework consisted of Carroll’s constructs of CSR based on economic, legal, social, and discretionary elements. The constant comparative method was used to analyze the interview data and identify factors leading corporations to continue to engage in CSR. These factors were economic, social impact, legal compliance, or good reputation, sponsored by transformational or adaptive leaderships and endorsed by visionary CEOs. The findings may enlighten and motivate other organizations to engage in CSR programs and connect stakeholders’ contribution to a broadened positive social change. (shrink)

The purpose of the following study is that of providing a critical anal‑ ysis of Intellectual Property (IP), with a closer look on copyright, in the context of human rights. My main conjecture is the following : the legal infrastructure stemming from the implications of copyrights which states created has nega‑ tive consequences if we have a closer look at some human rights specified by The Universal Declaration of Human Rights (UDHR). For example, copyrights are, in my view, incompatible with (...) the human rights which specify that (1) hu‑ man beings have a right to freely take part in the cultural and scientific life of the communities which they inhabit and (2) human beings have a right to own property. My main hypothesis is the following : if copyrights are, in fact, more difficult to ground from a moral perspective, then this considerations must trump the provision of the 27th article of the UDHR, which states that creators, be they artists or researchers, have a human right to have their moral and mate‑ rial interests protected with regard to their intellectual products, if this amounts to a justification for a copyright. There are two main questions that any account of corporate lawyers’ moral obligations needs to answer: (1) Do corporate lawyers have moral obligations to third parties? and (2) In cases of conflict between obligations to the corporation and obligations to third parties, which should prevail? This Article offers answers to these questions in the context of lawyers working in medical corporations. I argue that lawyers do have moral obligations to third parties, and that in cases where patients’ rights are being (...) violated by a medical company, patients’ rights should prevail. Consequently, attorney–client confidentiality rules should be relaxed to allow for attorney disclosures in egregious cases of potential harm to third parties. (shrink)

With AI permeating our lives, there is widespread concern regarding the proper framework needed to morally assess and regulate it. This has given rise to many attempts to devise ethical guidelines that infuse guidance for both AI development and deployment. Our main concern is that, instead of a genuine ethical interest for AI, we are witnessing moral diplomacies resulting in moral bureaucracies battling for moral supremacy and political domination. After providing a short overview of what we term ‘ethics washing’ in (...) the AI industry, we analyze the 2021 UNESCO Intergovernmental Meeting of Experts (Category II) tasked with drafting the Recommendation on the Ethics of Artificial Intelligence and show why the term ‘moral diplomacy’ is better suited to explain what is happening in the field of the ethics of AI. Within the Computer Science community, many ethical issues have emerged as significant and critical concerns. Computer ethics is an academic field in its own right and there are unique ethical issues associated with information technology. It encompasses a range of issues and concerns including privacy and agency around personal information, Artificial Intelligence and pervasive technology, the Internet of Things and surveillance applications. As computing technology impacts society at an ever growing pace, there are growing calls for more computer ethics content (...) to be included in Computer Science curricula. In this paper we present the results of a survey that polled faculty from Computer Science and related disciplines about teaching practices for computer ethics at their institutions. The survey was completed by respondents from 61 universities across 23 European countries. Participants were surveyed on whether or not computer ethics is taught to Computer Science students at each institution, the reasons why computer ethics is or is not taught, how computer ethics is taught, the background of staff who teach computer ethics and the scope of computer ethics curricula. The claim that ordinary ethical discourse is typically true and that ethical facts are typically knowable seems in tension with the claim that ordinary ethical discourse is about features of reality friendly to a scientific worldview. Cornell Realism attempts to dispel this tension by claiming that ordinary ethical discourse is, in fact, discourse about the same kinds of things that scientific discourse is about: natural properties. We offer two novel arguments in reply. First, we identify a key assumption that we (...) find unlikely to be true. Second, we identify two features of typical natural properties that ethical properties lack. We conclude that Cornell Realism falls short of dispelling the tension between ethical conservativism and ethical naturalism. (shrink)

Predmet istraživanja su izazovi nastavnika u radu sa učenicima iz osetljivih socijalnih grupa, tokom nastave u vanrednim okolnostima, uslovljenim pandemijom koronavirusa. U radu su prikazani rezultati kvalitativnog istraživanja, sprovedenog krajem 2021. godine, u okviru projekta Pravo na obrazovanje u periodu krize izazvane pandemijom virusa COVID-19 u Srbiji. U polustrukturisanim individualnim intervjuima učestvovalo je 50 nastavnika osnovnih, srednjih i škola za obrazovanje učenika sa smetnjama u razvoju i invaliditetom, iz 14 gradova u Srbiji. Tokom obrazovno-vaspitnog procesa sa učenicima iz (...) osetljivih socijalnih grupa, nastavnici su suočeni sa brojnim izazovima: digitalni jaz prvog i drugog nivoa, diskontinuitet u procesu obrazovanja, neodgovarajuća podrška u učenju od strane roditelja, nemotivisanost učenika za učenje, otežana komunikacija, teškoće u praćenju nastave, nemogućnost sprovođenja epidemioloških mera i individualnih tretmana itd. Sudeći na osnovu izazova nastavnika, učenici iz osetljivih grupa više su pogođeni obrazovnom krizom nego njihovi vršnjaci iz privilegovanih grupa. Neophodno je sprovođenje sistemskih mera podrške u cilju obezbeđivanja inkluzivnog pristupa obrazovanju. (shrink)

Cornell realism (CR), a prominent meta-ethical position that has emerged since the last decades of the twentieth century, proposes a non-reductionist naturalistic account of moral properties and facts. This paper argues that the best version of CR’s chosen methodology for arriving at justified moral beliefs must be seen as a variant of reflective equilibrium. In comparison to the traditional versions, our proposal offers a ‘social’ reinterpretation of reflective equilibrium in delineating CR’s epistemology. We argue that it satisfactorily accounts for objectivity (...) and calls for the inclusion of the social nature of both moral and scientific inquiries. Emphasising the social dimension of their epistemological account also nudges debates in metaethics into incorporating the much-needed social dimension while dealing with questions of moral beliefs and facts that have been of CR’s concern. Cornell realists maintain that irreducible moral properties have earned a place in our ontology in virtue of the indispensable role they play in a variety of explanations. These explanations can be divided into two groups: those that employ thin ethical concepts and those that employ thick ethical concepts. Recent work on thick concepts suggests that they are not inherently evaluative in their meaning. If correct, this creates problems for the moral explanations of Cornell realists, since the most persuasive moral explanations (...) are those that employ thick concepts. If thick concepts are not inherently evaluative, then the most plausible explanations on offer cannot support Cornell realism. Moral explanations employing thin concepts, however, are too flimsy to support the view. Unless proponents can develop a compelling story about thick concepts or thin explanations, Cornell realism is in trouble. (shrink)

Jason Springs’s Healthy Conflict in Contemporary American Society is a masterful attempt to practice productive conflict and democratic dialogue in the face of static antagonisms and deep‐seated divisions. In my response, I underscore Springs’s insistence on mediating between the moral imagination of Richard Rorty and the prophetic critique of Cornel West. For the author of Healthy Conflict, any hope in the survival of democracy relies on balancing critique of domination with constructive proposals for a more just and equitable world. (...) On the one hand, Springs rejects any strong distinction between moral imagination and socio‐political critique; in fact, he argues for their intertwinement, especially in the work of West. At the same time, there are moments when he suggests an opposition between expanding the moral imagination and engaging in the critical enterprise, especially as he identifies the limits in Foucault regarding normativity and democratic struggle. I respond to this slippage by arguing that Foucault, and critical theory more broadly, open up possibilities for rethinking ethics, politics, and our relationship to the violence that sustains the order of things. Moral realism and ethical naturalism are both highly attractive ethical positions but historically they have often been thought to be irreconcilable. Since the late 1980s defenders of Cornell Realism have argued that the two positions can consistently be combined. They make three constitutive claims: (i) Moral properties are natural kind properties that (ii) are identical to (or supervene) on descriptive functional properties, which (iii) causally regulate our use of moral terms. We offer new arguments against the feasibility of Cornell realism (...) and then show that there is a way to be a naturalistic realist that avoids internal inconsistency and uniquely provides for moral normativity. This article makes the case for the necessity of a multi-focal conception of violence in religion and peacebuilding. I first trace the emergence and development of the analytical concepts of structural and cultural violence in peace studies, demonstrating how these lenses both draw central insights from, but also differ from and improve upon, critical theory and reflexive sociology. I argue that addressing structural and cultural forms of violence are concerns as central as addressing direct (explicit, personal) forms of violence for (...) purposes of building just and sustainable peace. Moreover, religiously informed and/or motivated peacebuilders are especially well-appointed and equipped to identify and address violence in its structural and cultural manifestations. I the examine how concepts of structural and cultural violence, in effect, centrally inform the efforts of Martin Luther King and Cornel West to cultivate just and sustainable peace in a context as putatively peaceful and prosperous as the United States. Jedno od najznačajnijih pitanja u filozofiji morala jest predstavljaju li moralni zahtjevi ujedno i razloge za djelovanje prema kojima se trebaju ravnati sve racionalne osobe. Prema jednoj koncepciji, moralni apsolutizam tvrdi da sve racionalne osobe imaju dovoljan razlog da poštuju moralne zahtjeve. Prema tom shvaćanju, moralni relativizam je tvrdnja da neće svi racionalni djelatnici imati dovoljan razlog da poštuju iste moralne zahtjeve. manje je istraženo pitanje što se događa ako pokušamo povezati filozofski naturalizam s pitanjem daju li moralni zahtjevi razloge (...) za djelovanje svim racionalnim djelatnicima. u ovom radu bavimo se potonjim pitanjem. neki autori smatraju da prihvaćanje filozofskog naturalizma nije važno za ovo pi- tanje. Drugi autori smatraju da filozofski naturalizam implicira relativizam u pogledu praktičnih razloga koji nije spojiv s moralnim apsolutizmom. u radu argumentiramo za to da su oba gledišta donekle ispravna. tvrdimo da ako se naturalizam shvati kao ontološka tvrdnja onda se možemo složiti s time da naturalizam ne igra ulogu u razrješenju debate između relativista i apsolutista. međutim, ako se naturalizam shvati kao metodološko gledište, onda smatramo da naturalizam podržava relativizam u pogledu praktičnih razloga, tj. ideju da moralni zahtjevi ne pružaju razloge za djelovanje svim racionalnim djelatnicima. Did the pragmatic turn encompass the linguistic turn in the history of philosophy? Or was the linguistic turn a turn away from pragmatism? Some commentators identify the so-called “eclipse” of pragmatism by analytic philosophy, especially during the Cold War era, as a turn away from pragmatist thinking. However, the historical evidence suggests that this narrative is little more than a myth. Pragmatism persisted, transforming into a more analytic variety under the influence of Quine and Putnam and, more recently, a continental (...) version in the hands of Richard Rorty and Cornel West. In this paper, I argue that proof of the linguistic turn’s presence as a moment in a broader pragmatic turn in philosophy can be garnered from close examination of a single article, W. V. O. Quine’s “Two Dogmas of Empiricism,” and a single issue: whether the analytic-synthetic distinction is philosophically defensible. (shrink)

On je prvobitno, 1987. godine, poceo da izlazi kao zbornik, jednom godisnje, da bi od 2005. postao casopis, sa ritmom publiciranja tri puta godisnje, a od 2011. izlazi kvartalno. Takodje je dat i pregled svih tematskih celina, i to do kraja 2012. godine. Analiziran je detaljno jedan broj FiD-a, kao vazan dokument za promenu drustvene (...) atmosfere u negdanjoj Jugoslaviji i sa nagovestajima njenog raspada: naucni skup je odrzan 2. i 3. jula 1991. A book review of 'Mindvaults. Sociocultural Grounds for Pretending and Imaginining' by Radu J. Bogdan.

Kierkegaardovo misaono nadahnuće motivirano je dvama nezadovoljstvima: prvo se tiče spekulativne filozofije i njezine nemogućnosti da zahvati zbiljnost pojedinca u njegovoj egzistencijalnoj danosti, a drugo se tiče građansko-kršćanskog svijeta njegova doba koji je u rasulu i gdje je »individua« posve dokinuta prevlašću »gomile«. Kako postati samim sobom, »jedan jedini«, odnosno »individua« , pitanje je koje Kierkegaard postavlja u središte svog filozofskog interesa. Put od običnog opstanka do zbiljskog egzistiranja, odnosno od »gomile« do »individue« ostvaruje se kroz tri stadija. To su (...) estetski, etički i religiozni stadij egzistiranja. U ovom se radu analiziraju njihovi ključni konstituensi i suodnos iščitavanjem primarno tri Kierkegaardova djela: Ili-ili, Bolest na smrt, Strah i drhtanje. I dok je odnos između estetskog i etičkog stadija dijalektički, religiozno stoji naspram estetskog i etičkog u naddijalektičkom odnosu. Taj se nad-dijalektički odnos pokazuje ključnim za interpretaciju Kierkegaardova mišljenja. -/- Kierkegaard’s philosophical inspiration was motivated by two displeasures: The first one concerns speculative philosophy and its incapability to grasp the reality of an individual in their existential givenness, and the second one has to do with the contemporary bourgeois-Christian world that had been falling apart and in which the “individual” was quite abrogated by the domination of the “crowd”. How to become one’s self, “unique”, or an “individual”, is the question Kierkegaard places into the center of his philosophical interest. The path from a common survival to a real existence, i. e., from the “crowd” to the “ndividual” is realized in three stages, through the esthetic, ethical, and the religious stages of exiastence. This paper analyzes their key constituents and their interrelation with an analysis of thre of Kierkegaard’s works: Either/Or, The Sickness unto Death, and Fear and Trembling. While the relation between the esthetic and ethical stages is a dialectical one, the religious is in a supradialectical relation to the esthetic and the ethical. This supradialectical relation is the key to the interpretation of Kierkegaard’s thought. (shrink)

U ovom radu analizira se rešenje skeptičkog paradoksa koje pruža teorija relevantnih alternativa. Ispituju se i upoređuju dve verzije ovog rešenja: nekontekstualistič- ka čiji je tvorac i zastupnik Fred Drecke, i kontekstualistička koju zastupaju autori poput Kita Dirouza i Stjuarta Koena. Uporednom analizom nekontekstualističkog i kontekstuali- stičkog rešenja, dolazi se do zaključka da, iako oba rešenja imaju i povoljne i nepovoljne implikacije, Dreckeova teorija relevantnih alternativa nudi uverljivije objašnjenje, a zatim i rešenje skeptičkog paradoksa.

There have been times in the history of ethical theory, especially in this century, when moral realism was down, but it was never out. The appeal of this doctrine for many moral philosophers is apparently so strong that there are always supporters in its corner who seek to resuscitate the view. The attraction is obvious: moral realism purports to provide a precious philosophical good, viz., objectivity and all that this involves, including right answers to (most) moral questions, and the possibility (...) of knowing those answers. In the last decade, moral realism has re-entered the philosophical ring in powerful-looking naturalistic form. ln this paper we provide a dialectical overview: we situate the new wave position itself, and also our objections to it, in the context of the evolving program of philosophical naturalism in 20th century analytic philosophy. We seek to show that although this new contender might initially look like championship material, it succumbs to punches surprisingly similar to those that knocked out the old-fashioned versions of naturalist moral realism. It is often said that normative properties are “just too different” to reduce to other kinds of properties. This suggests that many philosophers find it difficult to believe reductive theses in ethics. I argue that the distinctiveness of the normative concepts we use in thinking about reductive theses offers a more promising explanation of this psychological phenomenon than the falsity of Reductive Realism. To identify the distinctiveness of normative concepts, I use resources from familiar Hybrid views of normative language and (...) thought to develop a Hybrid view of normative concepts. In addition to using this new Hybrid view to explain why reductive theses are difficult to believe, I show how to preserve several patterns of inference involving normative concepts that, intuitively, it is possible to make, and hence answer an important recent challenge to Hybrid views from Mark Schroeder. In this paper, I show how realist moral naturalists can provide an intra-theoretic explanation of the epistemic possibility of wholesale moral error. This is a requirement on metaethical theories that has been recently defended by Akhlaghi (2021). After clarifying Akhlaghi’s argument and responding to Evers’s (2021) recent rebuttal, I argue that even under the assumption that moral facts are grounded in an appropriate subset of natural facts (N-facts), there is still a non-zero probability of wholesale moral error. This is demonstrated (...) by considering three types of epistemically possible scenarios: specifically, it could either be that N-facts do not actually exist, or that N-facts exist in a way that entails wholesale moral error, or that N-facts exist in a non-error theoretic way, but their existence is temporally restricted. Ethical reductionism is the best version of naturalistic moral realism. Reductionists regard moral properties as identical to properties appearing in successful scientific theories. Nonreductionists, including many of the Cornell Realists, argue that moral properties instead supervene on scientific properties without identity. I respond to two arguments for nonreductionism. First, nonreductionists argue that the multiple realizability of moral properties defeats reductionism. Multiple realizability can be addressed in ethics by identifying moral properties uniquely or disjunctively with properties of the special sciences. Second, (...) nonreductionists argue that irreducible moral properties explain empirical phenomena, just as irreducible special-science properties do. But since irreducible moral properties don't successfully explain additional regularities, they run the risk of being pseudoscientific properties. Reductionism has all the benefits of nonreductionism, while also being more secure against anti-realist objections because of its ontological simplicity. (shrink)

US citizens perceive their society to be one of the most diverse and religiously tolerant in the world today. Yet seemingly intractable religious intolerance and moral conflict abound throughout contemporary US public life - from abortion law battles, same-sex marriage, post-9/11 Islamophobia, public school curriculum controversies, to moral and religious dimensions of the Black Lives Matter and Occupy Wall Street movements, and Tea Party populism. Healthy Conflict in Contemporary American Society develops an approach to democratic discourse and coalition-building across deep (...) moral and religious divisions. Drawing on conflict transformation in peace studies, recent American pragmatist thought, and models of agonistic democracy, Jason Springs argues that, in circumstances riven with conflict between strong religious identities and deep moral and political commitments, productive engagement may depend on thinking creatively about how to constructively utilize conflict and intolerance. The result is an approach oriented by the recognition of conflict as a constituent and life-giving feature of social and political relationships. (shrink)

There are three basic objections to the OQA: Geach's point, that Moore presupposes that ?good? is a predicative adjective (whereas it is in fact attributive); Lewy's point, that it leads straight to the Paradox of Analysis; and Durrant's point that even if 'good' is not synonymous with any naturalistic predicate, goodness might be synthetically identical with a naturalistic property. As against Geach, I argue that 'good' has (...) both predicative and attributive uses and that in moral contexts it is difficult to give a naturalistic account of the attributive 'good'. To deal with Lewy, I reformulate the OQA. But the bulk of the paper is devoted to Durrant's objection. I argue that the post-Moorean programme of looking for synthetic identities between moral and naturalistic properties is either redundant or impossible. For it can be carried through only if 'good' expresses an empirical concept, in which case it is redundant since naturalism is true. But 'good' does not express an empirical concept (a point proved by the reformulated OQA). Hence synthetic naturalism is impossible. I discuss direct reference as a possible way out for the synthetic naturalist and conclude that it will not work. The OQA may be a bit battered but it works after a fashion. (shrink)

In this paper I revisit an important response to the Moral Twin Earth (MTE) challenge: The Common Functional Role strategy (CFR). I argue that CFR is open to a revenge problem. MTE-cases allegedly show that two linguistic communities can be in genuine disagreement even when they are regulated by distinct families of properties. CFR provides a way to reconcile the intuition that the two communities are in genuine disagreement with the claim that the use of moral terms by both communities (...) is causally regulated by different families of properties. This is done by identifying a functional role that those families of properties both fulfill. Still, even if CFR is successful, its proponents need to face a serious revenge problem. Roughly, it could be that the families of properties that regulate each community are equally perfect realizers of the relevant higher-order functional state. I suggest that the proponent of CFR faces a dilemma: either CFR has controversial implications about first-order moral theory, or CFR needs to be coupled with substantive and parochial empirical/metaphysical assumptions to avoid those implications. The main aim of this thesis is to defend moral realism. In chapter 1, I argue that moral realism is best understood as the view that moral sentences have truth-value, there are moral properties that make some moral sentences true, and moral properties are not reducible to non- moral properties. Realism is contrasted with non-cognitivism, error-theory and reductionism, which, in brief, deny, and, respectively. In the introductory chapter, it is also argued that there are some prima facie reasons to assume (...) that non-cognitivism and error-theory are erroneous. In chapters 2 and 3, I suggest that the two main forms of reductionism, analytic and synthetic reductionism, are mistaken. In chapter 4, I argue that the considerations in the previous chapters in relation to non-cognitivism, error-theory and reductionism provide support to moral realism. It is also suggested that these considerations make it plausible to hypothesise that moral properties depend on non- moral properties in a way I refer to as ‘the realist formula’. The realist formula confirms moral realism since it implies that moral properties are not reducible to non- moral properties. In chapters 5, 6 and 7, I argue that moral realism, much owing to the realist formula, is able to explain significant meta-ethical issues regarding moral disagreement, moral reason and moral motivation. Among other things, externalism concerning moral motivation is defended. The explanatory value of moral realism in relation to these meta-ethical issues is taken to suggest that this view is preferable to non-cognitivism, error-theory and reductionism. Some of the meta-ethical issues discussed in these chapters, particularly moral disagreement and motivation, have been thought to provide support to non-cognitivism and error-theory. I maintain that since realism, unlike reductionism, is able to counter these arguments, it justifies us in upholding the view that moral sentences have truth-value and the view that there are moral properties. In chapter 8, various objections against realism with regard to the dependence of moral properties on non- moral properties are responded to. In chapter 9, I consider an influential argument to the effect that moral properties are not involved in causal explanations. I maintain that this argument fails and that it therefore is reasonable to assume that moral properties are natural properties. However, the discussions in chapters 8 and 9 also suggest that moral realism might face problems that cannot be thoroughly discussed in this thesis. (shrink)

Keith Donnellan wrote his paper on definite descriptions in 1966 at Cornell University, an environment where nearly everybody was discussing Wittgenstein’s ideas of meaning as use. However, his idea of different uses of definite descriptions became one of the fundamental tenets against descriptivism, which was considered one of the main legacies of the Frege–Russell– Wittgenstein view; and I wonder whether a more Wittgensteinian interpretation of Donnellan’s work is possible.

Pojem filosofie nabyl v průběhu historie řadu podob a významů. Kromě tradičního teoretického zaměření se lze setkat s přístupem, který vyzdvihuje praktický dopad filosofování na život člověka. Příspěvek představuje koncept filosofické praxe a reflektuje její současný stav na území České republiky. Autoři vymezují filosofickou praxi jako disciplínu filosofie, a načrtávají její možné dělení na dílčí oblasti. Nastíněny jsou její historické kořeny, které autoři identifikují v antickém Řecku. Dále se věnují systematickému představení doposud sepsaných materiálů k filosofické praxi a přehledu její (...) realizace na území České republiky. Detailní pozornost věnují autoři popisu tří jejích oblastí, mezi které patří filosofie pro děti, filosofický workshop a filosofická konzultace. Kromě teoretického vymezení reflektují rovněž své vlastní postupy v uvedených oblastech. Článek čerpá především ze zahraniční odborné literatury, konkrétně z textů a dalších materiálů filosofických praktikantů. Jeho cílem je představit českému čtenáři doposud podrobněji neřešený koncept filosofické praxe a připravit tak pole pro možnou debatu na akademické rovině. -------- The concept of philosophy has had several forms and meanings throughout the history. Besides the traditional theoretical focus, we may also encounter the approach that highlights a practical impact of philosophizing on one’s life. This text introduces the concept of philosophical practice and reflects its current situation in the Czech Republic. Authors characterize philosophical practice as a discipline of philosophy and present its possible division into subsections. They also present its historical roots, which can be found in ancient Greece. Moreover, authors introduce available sources dealing with the philosophical practice and describe how this discipline is actually practiced in the Czech Republic. Detailed attention is given to three of its sections, namely philosophy for children (P4C), philosophical workshop, and philosophical consultation. Authors present theoretical background and also reflect their own methods in these sections. The text draws primarily from scholarly literature from abroad, particularly from the manuscripts and other sources produced by philosophical practitioners. The aim of this text is to introduce the concept of philosophical practice to the Czech reader and prepare the field for further academic discussion. (shrink)

In this paper, I motivate skepticism about the causal efficacy of moral properties in two ways. First, I highlight a tension that arises between two claims that moral realists may want to accept. The first claim is that physically indistinguishable things do not differ in any causally efficacious respect. The second claim is that physically indistinguishable things that differ in certain historical respects have different moral properties. The tension arises to the extent to which these different moral properties are supposed (...) to have different effects on people. I will introduce a class of cases in which this tension arises and suggest that the moral properties in these cases have no causal power. I will also question whether there are differences between the moral properties in these cases and moral properties in other cases that do not involve physically indistinguishable things that could make the latter moral properties causally efficacious. The second way that I motivate skepticism consists in pointing out a unique feature of cases in which moral properties are supposed both to supervene on historical properties and to be causally efficacious. These cases allow us to change moral properties with alleged effects while we hold constant the nonmoral candidates for causal contribution to those effects. This feature of these cases is unique because in most other cases the moral properties supervene on the physical properties in the nonmoral candidates, such that we cannot change the former while holding constant the latter. This way of changing moral properties provides empirical grounds for testing their causal efficacy. (shrink)

This is a personal and philosophical reflection on the theme of acceptance as it relates to my grief journey following the deaths of my son and father (among others) in recent years. Its main premise is that acceptance is a state of being given, and, as such, we would do well to stop not accepting. To learn how to do this, I draw on a wide range of sources, from Christian and Persian mystics (Marguerite Porete, Simone Weil, Rumi, Hāfez), to (...) rock singers (Jeremy Enigk, Eddie Vedder, Chris Cornell, Kurt Cobain, Maynard James Keenan), to architects (Rem Koolhaas). I also dive into the Ancient Greek etymology of the word “acceptance.” The overall result is a philosophical guide into acceptance. (shrink)

In his 1998 postscript to ‘The Possibility of Resurrection’ Peter van Inwagen argues that the scenario he describes by which God might resurrect a human organism, even though probably not true, is still conceivable and, consequently, ‘serves to establish a possibility’, namely, the metaphysical possibility of the resurrection of material beings. Van Inwagen, however, has also argued in favour of ‘modal scepticism’ [van Inwagen in, God, knowledge and mystery: essays in philosophical theology, Cornell University Press, Ithaca 1995b, pp. 11–12; van (...) Inwagen in, Philos Stud 92:67–84, 1998a]. That is, he thinks that we should limit all our claims about what is possible to ‘ordinary propositions about everyday matters’, 1998a). In this paper I argue that van Inwagen’s modal argument as found in ‘The Possibility of Resurrection’ is inconsistent with his modal scepticism as found in ‘Modal Epistemology’. In consequence, I argue that, given his modal scepticism, the task van Inwagen set himself in ‘The Possibility of Resurrection’ has not been achieved. (shrink)

U ovom radu autorka nastoji da pokaže u čemu leže smisao, snaga i validnost Sokratovih argumenata protiv imoralističkog stanovišta o prirodi pravednosti. Njegovi argumenti nemaju samo elenktičku, pobijajuću vrednost, nego nam daju i uvid u neka načelna pitanja, poput prirode umeća, pleoneksije, funkcije, vrline, eudajmonije, te pružaju putokaz u kojem pravcu će se kretati dalja rasprava u Državi.

The existing research on the role of intellectuals in alleviating suffering has overlooked contributions by prominent Black intellectuals from the United States in the early 1990s. Two roundtable debates co-organised under the auspices of the Boston Review at Harvard and MIT in 1992 and 1993 in response to Eugene Rivers’ essay “On the Responsibility of Intellectuals in the Age of Crack” were central to these contributions, counting a star-studded line-up of Black intellectuals including bell hooks, Cornel West, and Glenn (...) Loury. Participants explore the role of Black intellectuals in the US, debating what they can and should do to combat oppression and domination. In this article, I recover the context of the debates, reconstruct their arguments, and make a case for their major historical and political significance. I comparatively interpret the two roundtables, identifying three major points of convergence. First, participants begin from a Gramscian conception of organic intellectuals, developing this further to defend the need for collective intellectual praxis. Second, the race-class-gender nexus plays a central role in structuring the very possibility of intellectuals affecting social change. Third, these intellectuals subscribe to a significantly pessimistic action paralysis, indicative of the relative powerlessness of intellectual debate in addressing structural oppression. (shrink)

Kate A. Manne is an associate professor at the Sage School of Philosophy at Cornell University, where she has been teaching since 2013. Before that, she was a junior fellow at the Harvard Society of Fellows (2011–2013), did her graduate work at MIT (2006–2011), and was an undergraduate at the University of Melbourne (2001–2005), where she studied philosophy, logic, and computer science. Her current research is primarily in moral, feminist, and social philosophy. She is the author of two books, including (...) her first book Down Girl: The Logic of Misogyny and her latest book Entitled: How Male Privilege Hurts Women. Manne has also published a number of scholarly papers about the foundations of morality, and she regularly writes opinion pieces, essays, and reviews in venues—including The New York Times, The Boston Review, the Huffington Post, and the Chronicle of Higher Education. Kako u svakodnevnom životu, tako i u pravu većinu ljudi smatramo odgovornim za postupke pretpostavljajući da su to njihovi postupci u smislu da nad njima imaju kontrolu. Pretpostavka koja dominira tradicionalnim filozofskim raspravama o moralnoj odgovornosti i teorijama kazne jeste da se osoba smatra moralno (pravno) odgovornom za počinjeni postupak ako taj postupak zavisi od nje na takav način da bi zaslužila osudu (kaznu) odnosno pohvalu (nagradu). Izazov koji prirodne nauke postavljaju pred ovakvo razumevanje moralne odgovornosti ne zaustavlja se na (...) klasičnoj mehanici već svoj novi, kompleksniji oblik zadobija pojavom kvantne mehanike, ali i razvojem neuronauke i psihologije. Relevantnost istraživanja prirodnih nauka za filozofske probleme objašnjavamo činjenicom da su drugu polovinu XX veka obeležila naturalistička metafizička i epistemološka nastojanja. Na ovaj način je otvoreno novo poglavlje odnosa filozofije i prirodnih nauka, a mi ga u ovom radu ispitujemo kroz razmatranje problema kompatibilnosti determinizma i moralne odgovornosti. Cilj rada je da ispitivanjem kako empirijskih argumenata kojima se u pitanje dovodi moralna odgovornost, tako i filozofskih argumenata koji figuriraju u ovim diskusijama ukažemo da rezultati naučnih istraživanja mogu biti plodonosni u kontekstu rasprava o slobodi volje, moralne odgovornosti i teorija kazne, isključivo ako na adekvatan način komuniciraju sa rezultatima filozofskih istraživanja zasnovanim na primeni filozofskih metoda poput metoda pojmovne analize. Any treatment of the relationship between pragmatism and politics would be incomplete without considering the multiple areas in which pragmatist thought and political studies intersect. Extensive scholarly work on pragmatism and politics can be found in the broad literature on political science, democratic theory, global political theory, public administration, and public policy. To a lesser extent, scholarship employing a pragmatist approach can be found in other subfields of political studies, including American politics and international relations. Unfortunately, the few works in (...) these subfi elds tend to appeal to a generic form of pragmatism (e.g., pragmatism as brute instrumentalism or pragmatism as vicious opportunism), not the robust version associated with classic and contemporary philosophical pragmatism.1 Most works on classic pragmatism and politics draw heavily on John Dewey’s political writings. Pragmatism’s two other founders remained relatively silent on the subject; in Robert Talisse’s words, “neither [Charles Sanders] Peirce nor [William] James wrote systematically about politics.” Neo-pragmatist treatments of politics can be found in the works of the late Richard Rorty, Cornell West, and Richard Posner. Mogućnost samouništenja čovečanstva čini stalnu prateću temu u svim knjigama Svetozara Stojanovića napisanim posle njegovog doktorata o metaetici. Kakve god da su teme inače obrađivane, našlo bi se ponešto i o ovome, isprva kao usputno zapažanje i mogući ugao gledanja na glavnu temu, a kasnije, sve više kao posebna oblast razmatranja ili čak kao vodeća perspektiva. U ovom radu rekonstruišem Stojanovićevo tretiranje ove teme. Pošto je kod Stojanovića reč o apokalipsi u sekularnom smislu, ja za nju predlažem, u otvorenoj (...) protivrečnosti sa izvornim značenjem reči, izraz apokalipsa bez otkrivenja. Reč je o apokalipsi u kojoj je preostao samo još kataklizmički aspekt, i utoliko ovaj izraz dobro sledi Stojanovićeve izvorne intencije. U radu izlažem i komentarišem sve faze Stojanovićevog rada na ovoj temi tvrdeći da ona čini jedinu konstantu u filozofskim i političkim menama njegovog mišljenja. (shrink)

Vydání Galileova Hvězdného posla vyvolalo okamžitou reakci mnoha evropských učenců, s jednou důležitou výjimkou, kterou tvořili jezuitští matematici Římské koleje pod vedením uznávaného matematika Christophora Clavia. Cílem článku je prozkoumat možné důvody opožděné reakce římských jezuitů, kteří se k nebeským objevům vyjádřili více než rok po vydání Galileovy knihy. Existují důkazy nasvědčující tomu, že i když byli římští matematici nakloněni uznání novinek odhalených teleskopem, nástrojem, který ještě musel dokázat svou důvěryhodnost, byli omezeni přísnými pravidly, která měla za úkol udržet jednotu (...) jezuitského řádu. Přibližně od druhé poloviny devadesátých let můžeme v sociálních vědách rozpoznat řadu tendencí, které nás opravňují hovořit o digitálním obratu v sociálněvědné praxi. Ačkoli důsledky digitalizace jsou pozorovatelné v mnoha oblastech sociálních věd, nejvýrazněji jsou zřejmě patrné ve znovuoživení očekávání spojovaných s tzv. dialogickým obratem a v diskusi rozpoutané kolem konceptu veřejné vědy.
